Claims:

1. Order the Defendant to immediately cease its acts of infringing the copyright of AutoCAD software owned by the Plaintiff;

2. Order the Defendant to pay to the Plaintiff the damages of RMB XXX for infringement upon copyright;

3. Order the Defendant to pay all litigation expenses and the relevant expenses suffered by the Plaintiff from this case.

  

Facts and Reasons:

The Plaintiff is the owner of the copyright of AutoCAD, a computer auxiliary design software. The Plaintiff has been entitled to the copyright of AutoCAD software from the date of issuance of the software, and registered the software’s copyright with the Copyright Registration Center of the P.R.C.

It is found out that, as of February 24, 2011, the Defendant used 40 sets of AutoCAD software without license from the owner, which had infringed the copyright of the Plaintiff and caused economic losses of RMB XXX to the Plaintiff.

In accordance with Clause 15 of the Tort Law of the P.R.C. and Clause 46 of the Copyright Law of the P.R.C., and to protect the legitimate rights and interests of the Plaintiff, we hereby bring this case with the Court and request the Court to render a judgment fairly and justly.
